Colin I'm not trying to flame you or anything but I don't think you understand. It is all fine and good for you to say with a wink that these rules won't be enforced that heavily and that everyone should just be calm but if that is what you think the problem is then you just don't get it.

These rules, read and interpreted explicitly as they are stated could serve to allow M$ to sue 99.9% of the makers of every machinima out there. The machinima's that stay g-rated, have no audio from the game, all orginal music, don't use any kind of mods or hacks, and don't expand on the existing Halo storyline are all but nil. In fact I've been working in the machinima community since nearly the day that Halo 2 came out and I can't think of a single one.

I've spent tons of money on equipment and tons of time working on movies and this is breaking my heart.

The issue here is not that these things were not technically legal. We all knew we were operating within the graces of M$ and any other IP we borrowed from. The issue here is that M$ has now enumerated these rules and has stated clearly that they plan to enforce them.

If someone told you not to do something that you knew was wrong or they were going to sue you would you still do it? Why even take the risk? I don't know about you but I don't have the money, time, will to fight M$'s legion of lawyers.

Most of us who do machinima regularly have invested money in software, equipment and even additional gamertags, game systems and games. I know I have. Machinima is an expensive hobby and I don't even do the 3D stuff. Most of us do this completely for free for the hobby and entertainment of our friends and the community. If I got paid the same hourly rate I do at my job for the work I do in machinima I could literally not work for a couple years.

M$ has taken all of that, all that effort and money and time and has threatened me if I continue to do it.

The ironic thing is that this will hurt them too. All the extra copies of the games I have bought. For machinima. The extra PC I had custom made at a heavy cost. For machinima (and loaded with M$ products as well). Video and editing software set to run in Windows (which means M$ got alicensing fee). For Machinima. Even the extra XBox I bought and the list goes on and on.

I guess it's time to find a new hobby. I suspect the Halo Machinima I am working on now will most likely be my last. I'm not saying anything definitive but I can tell you if I hear of even one person in the community getting a cease and desist or getting sued I'm done.
