Because of the more fluid narrative of : video games the antagonist changes often. But it could be argued that : every chapter, every level you play as the protagonist MC then whoever is : your main adversery for that level is your antagonist. That pretty much : rules out Hunter, The Arbitor, Gravemind, The Prophets, Tartarus and so : on. Then add to that the time you play as The Arbiter as the second : protagonist and you can rule out the Heretic, various Brutes, MC again, : Gravemind again, and so on. : Add to this the fact that you cannot violate any other IP's and that is the : stake in the heart that finishes machinima off. That's it. Game over. : Once you add in every other intellectual property. From the Halo novels. From : Halo Wars, any music you might have thought about using. Any sound effect : that you didn't purchase yourself. Even the soda machines in the game have : RvB's rooster symbol on it. Does that IP belong to M$ or RvB? What about : mixing another game in with Halo like the Sims or WoW? Nope. You just : violated their IP and that violates this agreement with M$. : Long story short we have huge problems here. What it comes down to is : enforcement. If M$ suddenly decides that they are going to enforce this : stuff then they have a real problem. First it will drastically effect : thier reputation in the community because due process will require them to : apply it fairly and that means to everyone making machinima. That means, : every major machinima maker will be gone. Because everything that has come : before now is in violation of this. Not to mention the massive amount of : what is to oome with saved films. : And don't think that you can just do this anonymously. The RIAA has found : over 20,000 people to sue for illegal music downloads. There are a lot : fewer machinim makers out there. And most of us want some kind of credit : for our work. : That said, if M$ uses this as a line in the sand, their stick if you will to : whack folks who eggregiously violate the rules with porn or some other : serious transgression and leave the rest of us alone as they have for so : long then it will be fine. And things will continue on as they have in the : past. : I hope for the latter. The question that has to be asked now though is : "who will be the first to stick thier neck out and see what happens : with some new content?" While I understand your concern, I think that it's probably a bit out of place. All that MS has done here is outline a policy. We really need to keep in mind that MS has drastically NARROWED the type of things that could be considered violations of their intellectual property; they have GRANTED a lot of rights to fans to use their IP. I think that the whole "backstory" and "lost chapters" thing does pose a bit of a problem, but i don't think that a reasonable reading of that limitation (in the context of Halo fan fiction and machinima) really rules out everything having to do with any characters/races/story elements from the games. It just wouldn't make sense. I suspect that you are right that MS is just going to lay this out as a stick to whack any egregious (according to them) infractors or infringers. In other words, they will almost undoubtedly enforce it selectively (which is well within their copyright rights). Also, I expect a clarification that allows people to enter contests that are either (1) MS sponsored or (2) without cash prizes.
