Video games are not just raw materials; they're not pigments and they're not just tools. There's a vast amount of original content within them, in the models and textures and audio even if we exclude the game engine. Those creations took a fair amount of work to make, too.
Machinima is the equivalent of collage work, the cutting out of images created by others and recomposing them. Photographers have taken exception to the use of their photography in collages without permission. Or take a look at samples; "Bittersweet Symphony" is a good example of how injudicious use of others' work to create a new one can end up.

I'll put it this way; are you okay with someone else taking one of your gameplay videos, dubbing a different soundtrack over it to make it "theirs", and then reposting it?^* (Especially if the redub sucks.)
-- Steve's just glad that now there's a way to truly "stake" a machinima work as one's own now in the eyes of the law.
^* Now, Woody Allen did this in essence with his hilarious redub of a Hong Kong karate film into What's Up, Tiger Lilly?. But he at least purchased the rights to the chop-socky flick he redubbed.
