It has nothing to do with censorship, it has to do with property. Microsoft has the right to allow or not allow anyone usage of their property. Actually, those Game Content Usage Rules are quite fair, and really not an issue to anything currently being done. The only issue they're very strongly enforcing is that you can't make money off of something made with their product. They even quote Creative Commons License, which is a very friendly maneuver, with the exception of sharing their game - of course, as is written. Fair use still applies and will defend you in most places, and it sounds like most machinima is fine. Having to add that line of text is not a huge chore, and it sounds like you'll probably only get in trouble for not having that line if your machinima is extremely popular. Even then, they'd just tell you to add it.
