Exactly.

Why would it be any different? They CREATED the intellectual property. There really isn't anything that give us a right to use it for anything creative (movie, machinima, story, artwork, whatever) without their permission.

Of course MS doesn't have any right stop people from making stories about red guys fighting blue guys. As you point out, they didn't create that idea. But, of course MS DOES have the right to control stories about red Spartans in Mjolnir armor fighting blue Spartans in Mjolnir armor, because the DID create that.

What possible reason could there be for only allowing MS to stop us from using their models in a different vidoegame? Just because we move the controls that make the Spartans onscreen do stuff doesn't mean that we are the only creators. MS is clearly also a creator (they created the models, the skins, the control scheme, the settings, etc.). We don't have any right to use their creations however we want.
