Video games arent just raw material, agreed, they are a composition of a lot of hard work. That does not exclude them from being tools for machinima.

That analogy to a collage would transpose better onto the case where someone takes the cutscenes and re-edits them into a music video or something. The video content they used was not original, it was structured, rendered and edited by someone else. The video created by a user playing a game on the console is entirely original. Thats where I might be incorrect in a legal sense, but thats the way I've always viewed this issue. I'm not posting files ripped of a disk, or selling illegal copies of the game, or even posting high res versions of the cutscenes (which in the past has even been allowed). Im posting my original videos.

Yes I would be OK with that, in fact we've asked for it at one point. However that hypothetical situation, same as your collage situation, doesn't make the proper analogy. Taking my original gameplay video and adding new sound is the same as ripping the cutscenes and adding new sound. I've always seen that as falling into the "Wrong" column but machinima is original video content that should be those of the person who created the video.

I realize the next argument will be that the flaw to my statement will go like this: "In your original video you use models and levels and textures that you dont have the rights to". And hey, thats a valid point, which is why I say I am probably legally wrong. But where is that line? I bought the game so I could play it, which includes seeing the textures and hearing the sounds. Who owns the video signal that comes out the back of my xbox? If I've "bought" the rights to hear those sound effects, does that mean that no one else is allowed to hear those sounds when I play Halo unless they have their own license for those sounds, meaning they own their own copy? I think you would agree that those situations are ubsurd, although similar situations have come up with viewing rights to movies or Pay-Per-View events. So now I want to record that video signal and watch it later. Can I watch it alone, or do I need to read myself a readme that states I made the video with microsofts approval. What if I want to show a friend, or show a lot of friends, or show to the Halo community? Where is the line? Why should I need anyone's permission? Or a better question, why would they do this, what benifit is it to them? Perhaps I haven't thought their motivations through fully and I'm missing something, but I dont see the why.

Sure, legally I might be totally wrong, but am I the only person who feels like they've been spit on?
