The lawsuit would be pointless, because the fan-fic uses copyrighted characters. If the case did go to court, it would be a wash, because you applied Microsoft's characters to your story. Microsoft taking your story and applying it to their characters would probably be seen as lawful, even though it may not be right.

That's not the same thing at all. The Elites != Geiger Aliens, etc. All of your examples have been modified enough that they don't break existing copyright. By the same token, you could come up with a space battle story about super-humans vs. aliens on a ring world and as long as enough details are changed it's A-OK. But you're not going to be able to get away with that using copyrighted resource materials I.E. the Halo games.
