Where it all REALLY gets tricky is when you consider differing levels of the various IP protection in different jurisdictions, especially as there may be different holders of differing rights depending on who e.g. published a piece of work. For example (and I may be wrong here - it's been a while) the UK has no real concept of fair use in the same way as America, a similar result is reached, but by differing mechanisms which can in some circumstances produce differing results.
