In Response To: Halo Ripping and "Intellectual Property"... (kapowaz) To me, the argument is about as simple as it gets: Bungie has said "we're okay with folks using promotional material we release, or collecting, without any 'reverse-engineering' (not exactly the right term, but the idea is analogous), material in-game for use in other projects... but we do NOT want people taking our direct assets from within the game itself and using them in other projects." Whether this request stands up in a court of law or not is totally irrelevant to me. I believe that if they say that's how they want it, that's how it should be - because they created the material in the first place. A long time ago, Double Aught folded as a company, and chose not to release ANY of the material they'd developed for the game Duality. This made many fans angry - they felt that it was a total waste of effort to simply bury the almost-finished project. If one of the team members had dissented, and posted the material for download on the web, you're telling me it's okay for folks to grab it and use it for future projects, EVEN THOUGH THE CREATORS SAID IT WASN'T? (It's not stolen material; one of the owners in this hypothetical did the releasing.) Nobody's gonna change my mind on this; I strongly believe that the creator of something has a right to say what can and can't be done with it. I really couldn't give a rat's ass what the COURTS say - I know in my heart what's RIGHT. And that's really all I have to say on this argument. Today is looking way too busy for me to get involved in a lengthy discussion on the subject - might be nice over a bottle of wine at 2 in the morning, but it ain't gonna happen today (at least not with me). I didn't want anyone to think I was hiding from the argument... but I'm not going to be contributing any more. |
