The thing is, as Flashman has stated, there are special circumstances protecting parody under "fair use" terms, whereas another (serious?) novel with the same character names and places wouldn't be able to claim this protection unless it was for the purposes of critique or commentary, which if it was simply another fiction, arguably it couldn't. But as Flashman points out, this really does become quite a legally difficult question, which is - as it happens - intentional. |
