I'm going to assume you don't realize that xbox 360 will come with a free 'sub level' of Live, called Xbox Live Silver.

Actually, I'm wondering if current subscribers are going to be automatically upgraded to XBL Gold when the time comes or if Gold is gonna be more expensive than the current service, but sorry, I'm getting off topic.

This is what it comes down to for me. If I have to buy new copies of the games I want, it wouldn't be completely horrible (although veyr undesirable) as there are only half a dozen games I'd actually want. I would however prefer if they could work it so that maybe you buy an HD with recompiled XEX's and just load the old game disc in and it gets what it needs from there OR if we can download the new XEX's over live and still just get what we need of the disc to play.

Oh well, the 360 still seems really far away and while I will buy it, I want to see what the starting price will be.
