Oh I'm sorry, you didn't jump to that conclusion immidiately, the Flood aren't exactly for being in complience with the Geneva Accords. I mean, if they weren't going to infect him what the hell else were they going to do with him? use him as a bottle opener. I don't know about any Info in Keye's head, but since 343 Gay ass Spark overrides the controls on the PofA, It seems to me that we could have just as well been beamed straight Betrayals to the Maw with no problems at all.
