Legally, I'm not sure. Potentially because there is rather a lot more involved in source code, though theft is theft.
In terms of a company though, I would imagine the source code is vastly more important than the retail game. There is all kinds of copyrights, patents and trade secrecy stuff involved in that. Having access to the source code can potentially allow for a complete re-programming of the game, and if it got in the hands of a rival company, they'd basically know everything there is to know about what makes a game, or any program, work.
I personally don't know if they would go that far, just that its a possibility. The FBI was certainly involved in the Half-Life 2 case, arresting several people involved and helping Valve track down the German hacker responsible.
In theory, I would imagine it would be easier to track down the Xbox 360s responsible, rather than a PC, because of the way serial numbers are logged and with the XBL marketplace being more closed off as it were.
That's how MS can perma-ban consoles as well as gamertags.
