In Response To: Re: I'm not a lawyer. but... (Chappy)

: I'm just frustrated that you don't see a
: difference between what you do consider theft (walking out of a store with
: something in your bag) and software piracy. Is it the greater potential
: for being caught (by security camera, staff, customers)? You say you do it
: "because you can"... do you mean "because you can get away
: with it?"

Exactly! (What are you trying to say here? What are you tring to achieve? Don't you evade on me here!)

Yes, I see the difference, and the answer to your questions is 'yes', 'yes' respectively. But it's how you see it, I download a certain game, simply because I can, that doesn't mean that I like the game that I'm downloading, in that case, I check it out, and if I don't like it, I delete it. However if I DO like it I might keep it for a while, and if I really like it I buy it. A game like Halo will be a great game, in that case, I won't even bother downloading, I'd rather walk to the local 'puterstore and buy it. (I would feel guilty if I didn't buy halo, because I LOVE the game)

: Hypothetically, if you could "download" hardware into your home
: without paying for it (except the cool bungie keyboard, of course), would
: you?

Interesting.. let me think...
..
...
Yup, to be honest, I would. If I could download a geforce 3, I would do so, even if it were just to check it out, I would buy it if it weren't too expensive, out of respect. (And I want Nvidia to create more, new, cards)

: Is it the physicallity of the hardware or software box that makes it
: theft?

You tell me

: I'm not "telling you to be guilty", I guess I'm asking why you
: aren't.

OK, I give up, I'm a THIEF!

: I have friends who write software, and piracy has always been a concern. If
: they dedicated resources to making software impossible to copy (I know, I
: know), wouldn't you then be forced to make a decision to buy or not buy
: (and not pirate)?

I'm a musician myself (or like to think that I am), I wouldn't like it if someone downloaded my music, I'd much rather want them to buy my CD (after all, I've been learning how to, and working, wasting a lot of energy, on it for years). But there's nothing I could do about it, apart from writing exceptionally great stuff, mentally hypnotising you, forcing you to walk to the store and actually buy one because you place me/or my music, very high in your upper-ego, and start accusing me of being a god, feeling guilty if you didn't buy it! You just HAD to have it in a material form. Wishing you could put cash in my hand personally, because you know a percentage (most of it) is going to the publishers/record company.
Again, I'm not saying that I download everything (There are CD's that I find good, prodigy for instance, and there are CD's that are shitty, exept for one song, in that case I'll use napster). I payed 25 guilder for registering a silly little program (few KB in size) called sid2midi (for covering old c64 tunes to todays midi standard), not only because I needed it but also because the guy who made it is a genius. The guy HAS the power to ask a rediculously amount of cash for it (it's not a program everyone needs, except for a few, it's not a hot thing to put on a warez site), but he didn't, and I respect him for that.

: The industry felt that way before, but changed direction
: to reduce copy protection in the nineties. Now I wonder if the ability to
: pirate you speak of will force a change on their part, and I *hate* all
: those stupid little hardware keys and key disks and code sheets and all
: that crap from yesteryear.

OH, I forgot to mention that you could download patches/cracks for those as well
(I suppose you're not the only one who thinks that way about keys and codesheets)

: -Chappy (who does pay Microsoft and Apple for OS upgrades, but I'm not happy
: about the former :)

Don't be a frustrated induvidual, give in to it, (Microsoft is ripping everybody of, in each version of windows they litteraly leave something out on purpose so you have to buy each and every time there's a new version), download windows XP, it is only a click away. But BUY stuff you think that deserves to be bought, stuff you use (Halo for instance). If you feel like buying windows then you do so. What do you mean by former?

BTW. I have often thought about a world (A new religion, star trek?), where you pay taxes (in form of 'credits') to contribute to technology (and some sort of democracy concerning technology that's being develloped). ATI, NVIDIA, PHILIPS, SONY all merged to ONE company, no competition. Whenever there's new technology, everybody can take advantage of it, everybody's equal, everybody has a computer/tv/car with the same specs. But ofcourse, everybody (companies) have different visions, and there's a materialistic thought behind it all, we, my friend, are exacly the same as the time when we were neanderthals, we're a bunch of silly apes wearing clothes and driving cars, polluting this earth (I often ask myself why cars still drive on fuel ISO water since it IS possible), wasting a lot of energy debating whether you should buy or download software, a pointless debat might I add, because half of the worlds population is doing it as we're debating. (What's the point of argueing when you're all alone?). We live in a dumb world, with a lot of stupid people, all you can do is accept it. Or die frustrated, or from skincancer.
