I've received a couple of DMCA notices for content hosted on hardware I own which is colocated (like halo.bungie.org and nikon.bungie.org). In both cases the notice was sent to my upstream provider. My upstream provider forwarded me the notice and told me to deal with it (rather than pulling my hardware immediately and then letting me sort it out later), but I don't imagine that all providers would do that. I think that, in general, they tend to send the notice to whomever owns the IP address which is hosting the site that contains the disputed content (which would make sense based on what has happened in my case, and in the cases of most folks I've spoken with). I don't know how Louis' colo provider handles DMCA notices, but I know that ThePlanet (where the files*.bungie.org boxes are hosted) has, for the most part, a 'pull the machine first, ask questions later' policy -- so I wouldn't be surprised that, if a files.bungie.org machine was hosting content that was the target of a takedown request, it would probably go down for at least some period of time. |
