I may be asking this question pre-emptively, but what happens if the RIAA does send a takedown notice to you? You've already made a public guess that a majority of videos here do contain unlicensed music; that's fodder against you if you opt to fend the recording industry off. I don't envy your spot, Louis; as a content hosting provider or as a human being, subject to the whims of the Digital Millennium Copyright Act. What's more is that even the mere threat of a lawsuit could put you and all site visitors squarely in the crosshairs of this problem; just look at what Macrovision threatened the maker of DVD Decrypter with. They only had to use the Mafia-like tactic of "turn over all your information and domain or we'll bankrupt you and ruin your life"; unless you've got a good lawyer and the financial wherewithal to support the legal weasel (;-)) then individuals fighting for "fair use" really don't have too much recourse. So my question is: what are you thinking about doing in the event that HBO is targeted? Or is that not planned and it's a "deal with it if it happens"? (On one hand, I'd love to see someone actually stand up and fight the RIAA for fair use; on the other hand, I think it'd be unreasonable to ask you to be that person - you've got a life outside of HBO and a family - and we all know how dirty the RIAA/MPAA can fight.) |
