I'd tend to agree, with the incomplete information that is at hand.

But it begs the question: if the AU can detect modified content, which is clearly a violation of the XBL TOS, and which Bungie has repeatedly warned will lead to a permanent matchmaking ban-- why is the ban not effective immediately upon the detection of the modified content?

Or at least as "immediately" as any other action on XBL, subject to the normal routines that updates statistics, clan memberships, Friends lists, etc?
