Actually the law does protect authors works against fan fiction if you publish it. It's just that most people choose not to prosecute. But then, Paramount once shut down every nonofficial Star Trek fansite on the net in anticipation of opening their official site...

With scenarios, however you have the implicit permission of the franchise owners, as a part of your purchase of Infinity, to create and publish them. Otherwise why include the editors? But then certain restrictions have been placed along with that - Bungie still owns the file formats and has not officially allowed them to be distributed, even if all the content is replaced. And of course they own the content of the games and you can't just distribute that...
