ahh, i dont think thats true. "Evil" doesn't prevent most people from commiting crimes. Its the fear of getting caught. And lots of people who can (or think they can, at any rate) get away with breaking the law DO.
Evil is completely relative to the person. Some people say abortion is evil, some say being a member of a certain religon is evil. Some say thats its evil to kill a person, but not evil to kill the person who did the killing. I dont trust the word evil, its been used as an excuse for far to many deaths (almost as bad as the word "god").
We try to base our justice system on morals, but those are relative too. I mean, well, cannibals.

geez, i dont know if that post makes any sense or not, its 2:00am here, and i dont think im thinking straight. sorry
