The source code for Marathon 2 has been released (under the GPL -- the license the Linux kernal was released under -- no less). However, that doesn't include level maps, the sounds, the graphics and all of that fun stuff that makes Marathon -- well, Marathon. Much of it can be (and is in the process of) being duplicated -- but that's public knowledge, and not likely to be hidden behind the gate.
