I've actually no idea what can be distributed (or not, as the case may be). Macintosh Garden has uploaded the Marathon alpha from the Trilogy CD (they incorrectly call it a beta).

Apparently someone on the Pfhorums uploaded the whole kit and kaboodle to megaupload.com until the FBI shut them down.
