You're right, but I'd still give the guy the game if he asked for it. Morally, that doesn't bother me at all. I'd never give him Unreal Tournament though, if he asked for it. Like I said, you are fundementally right, I just believe that this is a situation where the rules can be "bent" a little, not broken.
