Precedent for use and all that jazz. Yeah, I've seen the same thing happen in my other love...scale modeling. Some of what are called 'garage kits' or limited run fan-made models often sold well and were subjects people wanted to build, but weren't mainstream enough for the big companies and license holders to bother with. By and large, the lawyers from the IP holders wouldn't come down on small-time groups making models for sale in limited amounts, or for minimal profits. Sometimes though, a garage kit would interfere with a product that was coming out by a licenced company. The garage kitters would get a C&D order to shut down. What the legal part of it was, is that the IP holder had to agressively protect their IPs. If they didn't, they'd set a legal precedent that they don't care to enforce what's theirs. If they don't have a C&D letter issued, then they may lose the ability to enforce their IP when needed. It's not that they may have secretly not minded what the garage kitters were doing...in some cases, the kit was an add-on to an existing kit, not a full kit. That meant that anyone buying the garage kit part, still had to but the kit, driving the company's sales further than if the kit part hadn't been produced. Despite that, they still had to enforce their property rights.
