In Response To: Re: Halogen = Thieves (Recon#54) Once again, let me iterate my opinion is my own and does not necessarily represent anyone else at SSP. That said, you're painting this a heck of a lot more black and white than it is, and that's just a gross misrepresentation of the situation. If I walk across the street, smash my neighbor's car window, hotwire his vehicle, and take off with it, is that stealing? You bet it is. Except no one's doing or has done that. Not even remotely close. More like the neighbor is running a business that the surrounding community loves, and has a long, respected history of allowing volunteers to use of the company vehicles for uses that further his company's exposure and/or allow the community to celebrate his accomplishments and creations, as long as this is done pro bono. Not only that, but before he reached major fame, this kind of grassroots support is what kept his company going in the first place. So now, as a community volunteer, I'm using the company vehicle again, for the same purposes as it's been used for time and time again. He's well aware I'm using it, he's well aware what I'm using it for, and he allows me to go on using it for some three years. Finally, the legal branch of his company comes down and in their cold, unintelligent fashion informs him he needs to cut off this kind of community support or else. So, before I get a C&D letter, he comes and tells me the situation and asks me to stop, but reiterates he really respects and appreciates what I've done and is sorry he hasn't talked with me about it sooner. Is that theft? No. Does it come even remotely close to theft? No. Does it resemble theft? No. Can you call it theft within any reasonable doubt? No. So, again, is Microsoft legally within their right to pull Halogen's plug at this point? Absolutely. Does it also make them morally and ethically an ass given Bungie's history? Absolutely. I personally hold Bungie itself blameless, as they no longer have the final say over what they do nor are they allowed to nurture and support their community the way they used to. That they went the extra mile to make sure this went over smoothly between us speaks volumes about Bungie's inner spirit still being alive, and they've got nothing but respect from me for that. But that does not even the slightest bit lessen the putrid stench of of the larger matter at hand. The only thief here is Microsoft legal. The crime being gradually stealing the soul of Bungie until the our friendly neighborhood company continues edging toward being another lifeless corporate front without true control over its own operations.
