Legally speaking there isn't any such thing as "abandonware"; that's just a colloquial term to refer to things that, like PiD, have never been formally released under any kind of free or open license, but are generally ignored by their copyright owners, where violations are not prosecuted in practice.
I would think that your project would fall into exactly the same category as all those other things you list, like Macintosh Garden distributing it and Marathon scenario using assets from it: not technically condoned, but there's probably basically zero chance of anything bad actually happening as a consequence.
