Regret went before Truth gave him the go-ahead. Truth may have been perfectly ready to go, but he hadn't gone yet and nor had he told Regret to go (as far as we know). As for the Covenant not expecting humans to be on Earth, you should consider this: The Covenant as an alliance of multiple species is at least 410 (though probably closer to 1000) years old, and the prophets have been spacefaring for more than three millennia. Their first contact with humans was less than 28 years before the events of Halo 2. After thousands of years of exploring space, and finding innumerable forerunner artifacts, it seems reasonable that the Covenant would not expect to find humans in every system explored after 2525, even those known to contain significant forerunner artifacts. : The Covenant Construct: What was the covenant construct Cortana mentions in

Annoyingly enough, this is the only question I had at the end of Halo 1, and was the #1 question I wanted to be answered in Halo 3. :(
