It's not TCP itself that's at fault, it's the inherant latency of the world's largest TCP/IP network - The Internet™ (trademark and copyright Al Gore, a wholly owned subsidary of Microsoft Corporation). The Marathon networking code assumes lag will be negligable, and has no way of predicting actions or re-synching OOS players. This is likely what the developers are working on implementing now.
