I'm by no means any sort of expert, but 1) I think since Bungie released those things, it should be cool, and 2) considering the amount of copyright violations on google video and youtube and those kinds of sites, it woudn't be a big deal if there was an infringment. There are videos of Halo stuff up there, and Halo isn't thingied like Marathon.
