There actually wasn't an 'official letter'.

The original release of the Trilogy Box Set files was done after a conversation with SketchFactor; we agreed that as long as there was text somewhere obvious stating that Bungie still held the copyright, and that you couldn't, for example, SELL anything that used the files, we'd be fine. (That text is in the FAQ.)

MS Legal went nuts the day it opened, and we almost pulled it down. Sketch explained to them that pulling it down made far less sense than putting up an official EULA, since the files were already all over the net - and he explained that the Marathon 2 source code was open-source BEFORE the MS buyout.

Legal said 'hold tight - we'll get back to you.'

Sketch said 'just leave the page up until they do.'

That was mid-January, 2005. To date, Legal hasn't gotten around to solidifying their position.

Bungie HAS denied permission to include the Trilogy files on cover discs of magazines, because of the 'making money' bit.

So - there's no official EULA at this point - but the hardest and fastest part of the agreement is 'Bungie still owns the copyrights, and you can't sell anything you make using the files, but outside of that, they're free.'

With respect to this particular use - I think you're fine, as long as it says somewhere that Marathon is copyright Bungie. (last frame of the movie, whatever.)
