Bungie appears to have adopted a 'look the other way' approach to Marathon fandom, and it's products.
I spoke with Forerunners.org, adn ex-Bungie.org creator Steve Campbell about the Marathon copyright issue at length. Essentially, his view is that Bungie can't do anything to you if you're not selling the product in a mainstream venue. Case in point: My Marathon Shirt and Hoodie franchise. Apparently, Bungie cares very little unless their S'pht Logo starts appearing at in their local Walmart.
I agree with the fact Abandonware gives no supra-legal rights to individuals - but the reality that Bungie is smart enough not to sue it's fanbase says something.
