Already covered in the other posts but just for a semi-official response from our end (Resurrection), we made an effort early on to clue Bungie in on what we were doing, and they basiclaly just said, "Cool", and looked the other way.
As it is, all of the models are 100% from scratch, most of the textures as well. A large quantity of the sounds in Marathon were from royalty-free sources to begin with. The amount of Ctrl-V that went into this was extremely minimal and completely dwarfed by the amount of our own sweat (now there's a visual for you).
A big part of our approach to building the mod was to insure that we were as in the clear as possible Re: infringement -- which meant shooting down a lot of ideas like fan wear and goodies, and doing whatever we could to make sure that no one else made money off of our work *COUGH*fileplanet*COUGH*.
And well, we've been at it for some 5 years now. If anyone in authority really had a problem with it, they've had plenty of time to tell us about it.
The only thing sticky about our project might be the way we're taking someone's IP and putting it into a semi-competitor's commercial technology... but again, by now, all concerned parties weould have had plenty of time say something about it.
