The fact that something is abandonware gives you *zero* extra rights legally.
I don't know what INFESTED is, but if it's a Marathon scenario, you're allowed to use marathon's file formats, and now redistribute the data files, so long as you don't charge money for it, and so long as you give Bungie credit. As for trademark, scenarios using Marathon's engine have been using Marathon's name and world since Evil.
If it's *not* a Marathon scenario, then you should probably get some legal advice before you use Marathon's name or anything from its world. And you shouldn't use anything from the data files, period.
