Rubicon contains Bungie copyrighted material, and thus nobody can sell it. If you maybe made Rubicon without any Pfhor, S'pht, or Drinniol, or Marathon logos, changed all the Bob sprites, replaced all the missing aliens, changed all the proper nouns, and took the "Marathon" out of the name in the main screen, you could. But then, it wouldn't really be Rubicon anymore, would it?
