Well, I seem to remember Take2 getting Myth and Oni was to get Take2 to give up their share in Bungie.

The engine is an interesting question. In theory MS could own it, since it could be considered 'work for hire' and MS could consider it theirs.

On the other hand, the "Halo engine" is not very friendly to developers that don't immerse themselves in it. Bungie is good at using it because the people there have practically been drowning in it's setup for the past 9 years. You bring in a bunch of new guys via 343i and they're going to go "tag system?" "what do you mean i have to....".

At that point, you might just want to start over and license a well known engine or make a brand new in-house engine. Technically, they do have Rare. Rare is pretty damn good with engines. Since they're pretty much MS's tech research wing now...
