Re: A Mod Developer's Take on the Situation

In Response To: Re: A Mod Developer's Take on the Situation (Narcogen)

: Your disappointment is understandable. However, it is my opinion that it is
: not actionable. If LucasArts did shut you down, would you be surprised?

: Did you ever ask for permission to use their intellectual property?

: If you asked for such permission, would you get it?

: The entire mod community, when dealing with intellectual property that
: derives from third parties, seems to be living in denial. They know they
: don't have a legal right to do what they are doing. They know if they ask
: for permission, they won't get it. So they don't ask, and hope to be
: popular enough that people play the mod, but not popular enough to be
: noticed and shut down.

In response to your point, I would like to point out that our team made sure to acquire the necessary approval from LucasArts in order to prevent an event such as this one. Yes we did get approval, but we had to allow LucasArts to host our mod on their website (host a link to the download). Ever since the Galactic Conquest mod for BF1942, LucasArts revised their policies to be more lenient towards fan created mods for non-LucasArts games, I assume this would have been due to the widespread popularity of GC at the time (a fan created mod that was featured in multiple official video game magazines).

Now correct me if I'm wrong, but I was under the impression that Halogen had already pursued and acquired Bungie's approval for their mod. I'm not completely sure on that point, but I seem to recall at least a discussion of it in their forums.

As for the rest of your points, I understand where you're coming from and I can't say that I can fault your logic, but I still don't agree with Microsoft's general historical business practices of either buying out their competitors, or putting them out of business by brute force. That doesn't completely tie in with the situation at hand, but I think that it is important for companies as powerful as Microsoft to be at least a little altruistic towards people that pose them no more than negligable economic threat/harm. I'm sure that they could have handled this situation a little better than they did, but it's too late now I guess.
