The restriction EMR is redistribution of modified versions (from the readme). So we can't / aren't supposed to fix the Lua and release a working version for modern versions of the engine, for example. For Trojan I don't remember exactly if it's anything more than just a prohibition on porting to Aleph One, but I do remember there is at least that.
It may still be possible to get Trojan working with Aleph One's Marathon emulation, which raises the question of whether repackaging (as a post-patched zip file, rather than a .sit containing a patcher) is "fair".
