No, but it is mentioned in the B.net thread, by one of the Moderators.

Stosh: I just now asked Sketchfactor about it over MSN. He was told it was OK. So it is. Marathon 2 is indeed considered freeware.

Goweb: Sketch asked Jason. Jason said fine.
