And this is done all the time. This is why multiple foundries have their own Courier; why Linotype and Bitstream both have an Amelia (and Corel too, called Amy instead); why Helvetica has clones called CG Triumvirate, Pragmatica, and Swiss 721. You don't want to license it, so you make your own. I don't want to have to pay $39 for Modula Tall, and I wanted to learn how to make a font, and express some appreciation for Marathon and the community that's sprung up around it. It may not be the most original thing to do, but it is a well-established (and legal) practice. I never inspected a digital copy of Modula Tall, but reverse engineered the design from visual appearance. My most recent version has a number of completely original glyphs, and an entirely different set of lowercase letters than Modula. If you want Modula Tall, you'll have to buy it. If you want something "close enough" for uppercase only, Marapfhont will do. And that's good enough for me.
