There's no clear statement I'm aware of, but Microsoft acquired the rights to Marathon when they acquired Bungie (for instance, they were able to give their blessing to Marathon: Durandal for XBLA). The copyright statements still read "Bungie Studios"
As for the trilogy release, to the best of my knowledge, we don't even have an official statement from Microsoft legal yet--Claude was just assured it was OK to host them while they draw one up. If that's changed I'm sure he'll jump in here and tell us :)
