I'm not sure... but I assume that's why it's taking so long for it to be released.
As for Bungie's involvement:
First of all, they are mentioned in the credits. :)
Also, here's some stuff about it from the, guess what, Marathon's Story page...
About the credits (http://marathon.bungie.org/story/miscmar96-aug96.html): "Odyssey:The Legend of Nemesis which has portions copyrighted (1995) by Bungie. Special thanks to Alex Seropian, Jason Jones, Greg Kirkpatrick, Doug Zartman at Bungie Software and to Tuncer Deniz."
A bit more about it (http://marathon.bungie.org/story/newmay-june01.html): "Matt Soell (Bungie Studios) dropped into the Story Forum to pass on a little tidbit concerning an early Bungie game that never was a Bungie, namely Odyessy or should we say Archipelago. It seems Richard Rouse's comment that 'Odyssey - The Legend of Nemesis' was "once long long ago" a Bungie project is indeed true. Presumably Paranoid Productions took over the game in its early development and released the game we know today as "Odyssey - The Legend of Nemesis". Just a little bit of Bungie history for you. Might be worth giving the demo a spin. You'll find it at Paranoid Productions. :-)"
