Microsoft has to defend its intellectual property or else risk establishing a precedent that it is not defended, which can allow later violators to claim selective enforcement. Microsoft's legal department can't try and use the acts of independent Bungie fans (however sympathetic Bungie itself might be) as justification for failing to be vigilant in an attempt to punish Bungie. : Or, instead of a "hands off" approach, MS legal could come to the : conclusion that it should "never be up to the developers", take : over completely and go out of their way to be jerks about anything and : everything Halo-related. It could be a "dick waving" : extravaganza. That is more likely. Whatever wiggle room Bungie does would go away. : Corporate politics suck. Corporate politics between subsidiaries sucks even : more. Corporate politics between subsidiaries that don't understand each : other and start taking those differences personally? That sucks most of : all. As a studio within a studio, Bungie probably has even less autonomy than a subsidiary would have. A subsidiary, after all, even if wholly owned, is at least a separate legal entity. If people at Bungie were that unhappy with the situation, they could attempt to finance a management buy out. As a publically traded company, there might be legal obligations to consider such an offer if it was advantageous to Microsoft shareholders. I don't think this applies in the case of something as amorphously described as a "studio". There may be a legal structure in place, however, just one that outsiders are unaware of.
