It is not crystal clear to me that MS is entirely within its rights to issue cease and desists to non-commercial fan projects. From a practical standpoint, they are able to do so because the average fan project cannot afford the legal representation to test whether or not MS is within its legal rights. By the same token, Microsoft could very well order you to take the entire fan fiction section offline. Those stories use intellectual property of Microsoft in unauthorized derivative works. If they ordered such, would you do it? Just curious. Of course, I understand that even with a non-commercial mod, there are commercial concerns. If there was a good, free Halo mod for an RTS engine like C&C, it might take away sales of a licensed Halo RTS. Of course, if someone argued that the Fan Fiction section affects Halo book sales I think the reaction would be a little different. Frankly I don't see why anyone isn't trying to add in a few jokes and go the parody route with these kinds of derivative works. The Weird Al Yankovic song that mentions Halo 2-- "You're Pitiful"-- was approved by the artists he parodied, but not the label. So he gave it away for free, and the label could not stop him. The juggernaut that is steamrolling over audiences in the name of protecting "intellectual property" has gone pretty far, but it hasn't quite yet removed all possibilities for creating legitimate non-commercial derivative works in particular contexts.
