No. Does it come even remotely close to theft? No. Does it : resemble theft? No. Can you call it theft within any reasonable doubt? No. I will admit that your analogy is a bit more accurate and relevant than mine (which was intentionally painted in monochrome to make a point). But it is not an accurate one that I can see. But while Bungie is a company that has strong community ties, they have never given up their property to the community EXCEPT when it was on their terms. (an excellent example being Marathon going open-source and the game files later being made available) It was their property and they decided when, where and how it would be used. Not the community, not the volunteers, Bungie. And they have never just "let it go". Bungie has never (to my knowledge) just "left the keys in" and let the community "do what they thought is best". Whenever they have licensed and released rights to their property, it has always been clearly defined and widely known. What examples do you have of Bungie historically "letting anyone use the van for good reason"? In your example, someone is "taking the van" without express permission because they "figured it was cool". Now, that shows a lack of malice and a measure of presumption, but it does not mean that the use of the van was permitted or proper. I'm not being unsympathetic, but I am saying that any undertaking such as this must follow guidelines. If no permission was obtained, and yes, even if it was asked for and no answer was given, that still means that there has been no expressed consent.
