Just because you do not profit does not make using someone else's IP legal, I'm afraid. (Technically, I believe that fan fiction *IS* illegal, and,if MS sent Louis Wu a similar letter, you can bet he'd take it down in a jiffy.) The other thing is, if you get sued, you don't have to pay based on the profit you made but rather based on the damages to the other party. If MS can argue (and they've got pretty good lawyers, you know) that this made use of their IP and harmed their profitability, well, Halogen would be pretty much screwed, even though they made no money off of it themselves. And as far as the "competition with a Bungie RTS" argument goes, I'm pretty sure the competition in question doesn't have to be that direct. Just competing in the the video game market as a whole (which, of course, it would) would be enough. It IS a shame that Halogen is no more, and it may be a pretty shitty thing of MS to do, but legally I think MS is in the right. -Sep7imus
